He obviously knew he didn't magically acquire $310k. This man would steal your car if the keys were left in it. If he walked in the bank and the vault was open with $310k sitting there and he took it would he be a criminal or just someone taking advantage of the banks mistake of leaving the vault open? In the end it was his mistake for stealing the money, and he should have to pay dearly since he stole more than he will ever be able to pay off, and he knew it when he took it.
but is it really stealing? the Bank is the one that made the error and put the money in his account.
he didn't take it by force, he didn't walk in somewhere pickup a duffel bag full of cash and then walk out.
would anyone feel differently if the brinks truck had gotten the wrong address, and just left $310K on his front door step?
sure it wasn't his money, but that's not his fault.
morally, it's wrong. ethically it's wrong. but is it legally wrong? is there any law that says you have to give back money that was erroneously given to you?
what if you find money on the side of the road?
bigger question, had he called BoA and reported it, and said this money's not mine, would BoA have rewarded him for doing the right thing?
