11a on your 4473 deals with this. If you are buying the firearm and giving it to your acquaintance without accepting money (a gift) you can tick yes and buy it then give it to her. If you are buying it and she is paying you for it you are straw purchasing which is illegal. Keep in mind that it is illegal to give it to her if you know or have reason to believe that she is a prohibitive person.

My wife bought me the Colt 1911 I have on my belt at the moment as a wedding present. I filled out the paperwork to cover our asses. It's not like it's a hassle to do so.

Thank you! No, I am not playing middle man here, I am buying it. She's clean and if needed I will take her with me the day I go pick it up so the proper paperwork can be filled out. I just figured the guy at the shop would know the procedure and inform me of the proper way to go about this.

Question about this. I want to buy a gun for a female acquaintance, I even told the guy at the gun shop my intentions and asked if she needed to provide anything for the purchase even though I'm the one buying. He said no, that once I pay for the gun and leave the store he doesn't care what I do with it. Does this sound right? I purchased a Glock on this same day for myself with no issue. All he did was make a quick phone call and asked for my ID.

No, they do care. It is a federal crime and they are at fault for knowing even if it cant be proven. I did this once for aanother Marine buddy, not knowing that was illegal because private transfer without registration was legal in my state at the time. I had my permit so I said I would buy the ACR he was going to purchase. His permit was from out of state and his address was out of state. The dealer at that point said absolutely not, and that the only way he would sell the ACR to us at that point was if my friend brought in his orders and a Wa state ID. He said if I tried to come back and buy that exact gun by myself he would not sell it to me.

Edit: Just read all the comments to this. The guy Blown89 is talking about is Power_Shift and I believe there are two brothers as well that are dealers. One is Philly and his brother is lilPhilly and they post often in the Gun Porn thread.

The other thing with gun shows is that they are secure as well. In order to purchase at a gun show you have to have a badge. In order to get a badge you have to provide a valid permit and ID for registration which goes back to proving you have a clean background. In my state you cannot purchase a firearm without a badge. You can only purchase accessories. So essentially, purchasing at a gun show is no different than purchasing at a store.

I wouldn't plan on the sales people at the shop giving you correct information. I've heard some terribly inaccurate things uttered across the sales counter before. Here's the form you will be filling out....the last page has a paragraph that goes into detail:

There was also a supreme court case that dealt with this a year or two ago. I don't remember the specifics but it's out there for anyone that cares to double check my nonsense.

Being completely blunt, your scenario sounds a bit off which is why it sounded (and still does to be honest) like a straw. You say your broad is clean and all but why not just have her fill out and sign the application? You are not surprising her with a puppy or a hamster. I understand it is a "gift."

Many people think a S.P. is only when you buy a firearm for someone who can not legally pass the back ground check but it also deals with a person who ddoes not want their name on the app. thus being associated with the purchase.

If you truly want the gun to "feel" like a gift when you give it to her, here's what I would do (and it will cost you a few extra $ for this effect): Buy said gun. It will obviously be registered in your name at that point. When you decide to present her with the "gift" tell her that in order for her to take possession of it you guys will have to make a quick stop at the gun shop to sign the transfer paperwork. It will cost a few extra bucks for you to transfer it over because she will have to have a background check done, but it will feel more like a gift I suppose.

Not sure why I'm explaining myself to you, BUT. I am in no way a gun enthusiast, I own a couple for home protection, period. I asked the question because I DO NOT know the law regarding me buying a gun for someone else. Am I wrong for trying to be informed? Would you rather I just go in, buy it, and give it to her? Should I not try to do this legally? If she needs to fill the form out that's what we'll do. Contrary to popular belief every poster on here isn't an expert at everything. Straw Purchases are highly illegal and to me it sounds like that's what you are describing. Why not just have her go in and fill out the paperwork and you pay for it.

Of course this could be moot depending where you are buying this firearm.

Is 2blackgt admitting to a crime? He might want to let th his one go.

Pretty much. What started with people fighting for their lives has evolved into people fighting for their rights. It sucks but it's the truth. It's not about turning this thread political, it's about following what the story has evolved into.

Why is it that the people whose lives were lost matter more than those whose were saved? I'm alive because of 2A rights. That's why I take firearms seriously.

What if we moved this to the political section so the discussion can continue?

You are explaining yourself in an attempt to remedy a scenario that sounds off at least to me and a few others here.

The lament you are giving is nothing more than dancing around a very simple asked of you. I don't care if own firearms, if you are an enthusiast, which college football team you like, your taste in music, the name of your dog or anything of the sort. I'm merely trying to find out why you wouldn't have the chick sign her Hancock in the first place.
