Get as much as you can documented in writing by doctors and specialists, the best time to ensure that you will be properly taken care of is right now. Glad that you and your son were able to basically walk away from the accident - from the looks of the hit, anything smaller and the story could have been much different.

Why the f#$- is everyone so quick to sue anymore? The guy stated they were ok??? Sometimes accidents do happen and people should not be using an accident to "get theirs" - this is part of what's wrong with society anymore, greed and entitlement! Now if the other driver was drunk, giving his boyfriend a blowjob, et frpp - then I could see lawsuit...

a head on collision, unless the person had a random heart attack or seizure or something of the sort, it not just an "accident that does happen"

we're not talking a rear end collision or they were in their blind spot and got over and side swiped them....those are accidents.

head on is negligence

Glad you and your child are okay. On a more serious note, go get you and your son checked out by specialist (such as a chiropractor). You may not feel it now, but you may start hurting down the road, and it will be too late to collect fee's for the damages

This! Definitely get checked out (both of you) by a specialist. And, definitely talk to an attorney. Don't assume the insurance company will be fair with you. They're goal is to do the least. Been there. Done that. I was hit by a young kid a few years ago. I had minor neck pain but I went to a specialist. My son-in-law recommended that I also talk to his attorney. I did, and doing both things paid off big time. The other insurance company started making a fuss about my follow-up visits to my doctor (with treatment). My attorney got involved and put a stop to their nonsense. I ended up having ALL of my medical expenses/treatments paid for with an additional $4K for pain and suffering. If I didn't use an attorney I would have had issues with some of my medical bills being paid. They also wanted me to take this to trial but I refused, even though it would have been an easy case to win for us with a much bigger award to me. I wasn't in it for the money. But the $4K settlement for P&S was a nice thing.

I also agree that in many cases more severe pain doesn't manifest for days. Which is why if a person feels "fine" right after an accident they should not assume everything is fine. ALWAYS go to the hospital, or to your doctor, for a thorough check. Doing the right things up front to protect your and your loved ones can save you time and aggravation when then dealing with the insurance company. JMO.

You will be getting a buy off from the insurance company. In most states you have two years to have your claimed finished. I had an accident two years ago. Not my fault. The other insurance will want to get this squared away as quick as possible, so make sure you are ok. You might experience pain several days from now, so do not be in a hurray to settle. Take your time, make sure you both have zero issues.

Not saying you need a lawyer, but document everything. Normal pay off is 3-5 times you medical bills and lost wages. At least mine was. That is the norm in my state.

Good luck, and I am glad it wasn't worse.

Because the insurance company will be the first people to try to settle with you before your injuries are healed, and you will be stuck with the medical bills for rest of your life. A lawyer keeps you from doing something stupid.

Get the boy to a chiropractor, or even better a kinesiologist. What kind of car seat did you have and how was it hooked up? Lap band through the back of the seat? What did he hit his head on, back of the passenger seat? Glad your ok.
