Not really. Sct has found a way around the wording for now. Plus the particulate limitations only apply to 08 and newer trucks. I just don't understand how the EPA is going after tuners for this stuff. They are selling these products as off road just like you can by an off road catless x. I guess they are the easy big target. It just boggles my mind that people think less particulate matter at the cost of using twice as much fuel is a good thing. I know it's not the epa's fault they didn't design the dpf system the manufacturers did but its still the only way any one has come up with to control particulates. I guess I should be glad they aren't going after the little guys otherwise we would be in a world of hurt.

I think the biggest reason this happened is because the EPA probably gets a ton of complaints about diesel trucks blowing clouds of smoke. The fact is the general public doesn't like it when guys go around blowing smoke all over people intentionally. These truck drivers are just asking for the EPA to step in a put a stop to it--and they did.

Hopefully this will start a movement towards efficiency in the aftermarket diesel industry. Dumping tons of fuel out the exhaust isn't exactly the most efficient way to make power. Easy power yes... efficient no. Banks Engineering has some cool vehicles with clean diesel technology--including one that was a 7-8 second drag truck that put out hardly any smoke. If there is any future in the aftermarket diesel industry, clean diesel is it.

There are only a couple recognized specializations for attorneys. I work mostly in intellectual property, cyber law, and energy law.

If you ever do or really consider it give me a buzz, I would contribute what resources I can.

I've heard the same thing from quite a few companies.

well my resources would obviously be on the legal side. I did not know if you were practicing down in SC. Those are some interesting areas of law. I have tried to use my automotive background in areas such as lemon law arbitration and clients in the auto industry, not my only fields but my relevant ones.

The EPA generally make an example of one single manufacturer and publicizes the action taken against them. Then leans on all other makers of the same general devices and suggests that they will be next if they don't comply.

So look out Bully Dog, Gale Banks and so on.

A few years ago they tried to go after Jegs and Summit and were told to go pound sand. Their attorneys produced documentation that every single part sold that was not in compliance was marked for off highway racing use only and that the purchaser has stated in writing that these parts will never be installed for use on a public highway or road. And the EPA had to back off.

LOL at all the hippies that think this is great now, and when they go after hi performance cars they'll all be whining. At that point it will be too late. The EPA needs to be put on a leash, they can come up with regulations that have to be complied with no matter what the cost is to the industry. Meaning if it makes the product not feasible to make then you have to scrap the idea rather than compromising for the "greater good." I think that is a phrase the libs love anyways.

Its funny when people who are insanely smart like Neil deGrasse Tyson even know "man made" global warming is a farce and a scam. Were still coming out of an ice age, so no shit sherlock things are going to get warmer.

I am not a tree hugger but the EPA and EPD are mearly trying to keep us from ****ing up the environment worse than we already have.

Uh yeah, I am going to just go out on a little limb here, and assume that your are not very well informed.

Anyone naive enough to believe that the government or any agency such as the EPA has people's or the planet's best interests in mind and are just trying to do the right thing doesn't deserve the liberty that is being stripped from them under false pretenses.

Compound the fact that the majority of the "experts" employed by the government are government employees because they aren't capable of working in their field of expertise in the private sector and that pretty much sums up all that needs to be known about the EPA.

(Washington, DC - January 17, 2013) - In a settlement with the United States on behalf of the U.S. Environmental Protection Agency, automotive electronics manufacturer Edge Products LLC (Edge) has agreed to pay a $500,000 civil penalty for manufacturing and selling electronic devices that allowed owners of model year 2007 and later diesel pickup trucks to remove emission controls from their vehicles. Diesel trucks that are not equipped with emission controls known as “diesel particulate filters” emit excess particulate matter (PM). When running, trucks without these types of controls leave behind a trail of dark, black smoke. PM is associated with a number of health problems, including respiratory and cardiovascular disease, chronic bronchitis, decreased lung function, and an increased risk of lung cancer.

Overview of Company

Edge Products, LLC (Edge) is an automotive electronics manufacturer based in Ogden, Utah. The company was founded in 1999. The electronic devices at issue in this case were sold to authorized distributors and directly to individuals throughout the United States.

Violations

Federal law prohibits any vehicle or engine from being sold in the United States unless it is covered by a valid, EPA-issued certificate of conformity indicating that the vehicle or engine meets applicable federal emission standards. The law further prohibits anyone from manufacturing or selling any part that defeats or bypasses the emission controls that are used to meet the standards. EPA sets different emission standards for different types of vehicles and engines.

Since 2007, heavy duty diesel trucks must meet stringent emission standards for particulate matter (PM) and other pollutants under EPA’s regulations at 40 CFR Part 86. In order to meet these standards, heavy duty diesel trucks generally must be equipped with an emission control device known as a diesel particulate filter (DPF), which collects and burns soot from the engine exhaust. To ensure that the DPF functions properly, it is continuously monitored by the truck’s computer. If the truck’s computer detects a problem with the DPF, or if it has been tampered with or removed, the vehicle’s “check engine” light is illuminated and the vehicle may not operate properly.

Between January 2009 and April 2011, Edge manufactured and sold a variety of electronic devices intended for use with model year 2007 and later GM, Ford, and Dodge diesel pickup trucks, which allowed users to reprogram a truck’s computer so that the check engine light would not illuminate and the vehicle would continue to run even after the DPF had been completely removed. In total, Edge sold more than 9,000 of these products nationwide under the Edge Racing brand name. In doing so, Edge violated the provisions of Title II of the Clean Air Act (CAA), which prohibit the manufacture and sale of parts or components that defeat or bypass an emission control device that is installed on a motor vehicle.

Pollutant Impacts

PM, especially fine particles, consists of microscopic solids or liquid droplets that are so small that they can get deep into the lungs and cause serious health problems. PM is linked to a variety of problems, including increased respiratory symptoms such as irritation of the airways, coughing, or difficulty breathing, decreased lung function, aggravated asthma, and premature death in people with heart or lung disease.

EPA estimates that the illegal devices sold by Edge will result in 158 tons of excess PM emissions. This is equivalent to the emissions from 422 new long-haul semi trucks operating for a period of 29 years.

Injunctive Relief

The settlement requires Edge to do the following:

Offer to buy back the illegal devices from anyone who possesses one. In order to sell a device back to Edge, the truck from which the device came must be returned to its original factory programming; and
Spend at least $157,600 to fund an emission mitigation project to offset the excess PM emissions resulting from the use of its devices. The funds provided by Edge will be offered as rebates to individuals who own old wood-burning stoves and who wish to replace them with cleaner burning appliances such as new pellet stoves or EPA-certified wood stoves in selected geographic areas with severe PM pollution. The rebate program will be implemented by an independent third party selected solely by Edge. Further details about the rebate program, including eligibility requirements, will be available after the third party has been selected.

Civil Penalty

Edge will pay a penalty of $500,000. This amount was reduced substantially in light of Edge’s current financial condition.

Comment Period

All this off road x pipes and long tubes with no egr provision are probably gonna get fined as well . Environmental laws are really getting enforced makes me nervous driving my car around now days

Exactly, and people are naive enough to follow along with it until it's too late. The EPA should stay away from the minority of Hot Rodders. It just isn't right.

The EPA is HORRIBLE. Anyone who supports 99% of their actions over the last decade is ****ing clueless, period.

Don't forget the EPA was the largest supporter of the cap & trade tax. For those that don't know, the goal is to purposely increase the price of carbon-based energy, (coal, gas and oil) so consumers would respond by using less. :mj:

It got killed in the Senate but now the EPA is bypassing Congress with its own backdoor climate regulation.

It's even been confirmed by them that without similar steps by other countries, like China, that refuse to curb their carbon output, it will produce no measurable change in world temperatures.

The EPA wants to threaten trillions of dollars in higher costs to Americans — in exchange for absolutely no improvement in the climate.
