Interpreting male and female sex according to biology (science) is now bad!
If you refuse a field sobriety test you get arrested and taken to jail where they have an instant warrant waiting to do a blood test. You then sober up for a few hours and get released with a pending court date and suspended license .
His car would be towed and impounded. The blood test is then used in court to convict you for DUI.
The guy fought because he was already on probation, had a previous DUI and likely thought he'd be going back for good. Play stupid games, win stupid prizes. Clean Shoot.

You do not get an instant warrant. A judge still has to agree which could take hours. So infact you could actually beat the case by refusing a field test which officers has been known to lie about. You can refuse the breathalyzer, you can refuse blood. Thats when they have to get warrent.

So to save some time, I googled your point. He pulled the Obama crap about not defining a sex. This means you have to define what sex you are on medical records. Which is kinda important. I dont see this as affecting lesbian, gays, queer, or the like. Only transgender. So it does make sense if you use rational thought.

I am aware of the "slobber up while waiting game". Even if you fail a field test, visuals are always challenged (I'm just clumsy!) and a breathalyzer is hit or miss sometimes. It's the blood that counts really.
By instant, depending on where you are the warrant is already approved before they finish booking you and a trained certified officer is waiting to do the quick draw. But yes, a busy station, you could be sitting for an hour or two and bang, you may eek under the limit.
The may still push it with the other evidence, they may drop it. Depending on state however, refusing a field test is an automatic 1 year suspension even if you don't get a DUI.
Rayshard was so ****ed up he'd never have passed the blood test.
Thats why you get a lawyer immediately, that way you can hold your trial with the DMV to keep your license untill proven guilty in a court of law.
Also when taking a field test always make sure to tell the officer you are not qualified to take the test and pass. When the officer ask if you understand make sure to say no. All this stuff goes into the report. Its even better to have the officer cameras on.
You may go to jail for the night but this way you have a chance of not loosing everything you worked for.
The less you say the better options your lawyer maybe able to help you.

You are able to have a hearing with the dmv. Maybe it a Ca thing. That way your able to keep your license till found guilty in the court of law.

I think he is saying it's better to not be in such a situation vs knowing ways to "beat" the situation.
Yeah, that sounds like a CA only thing. In several state, if you refuse to blow, your license is gone for like 6 months, no questions asked, instantly. What you can later then do is go in front of a judge, pled your case that you own a delivery company and your family will go bankrupt if you don't work or so, and the judge can issue you a license to only drive to/from work. I know someone who got that.

Indiana, you refuse a field sobriety test, you lose your license for a year. Period.
You even sign a form acknowledging that when you get your license.
