Is there a section in the CVC that states this? What is the number?

My argument is this....this is the section I recieved....

(b) No person shall operate or leave standing upon ( )1 a highway ( )2 a motor vehicle that is required to be equipped with a motor vehicle pollution control device under Part 5 (commencing with Section 43000) of Division 26 of the Health and Safety Code or any other certified motor vehicle pollution control device required by any other state law or any rule or regulation adopted pursuant to that law, or required to be equipped with a motor vehicle pollution control device pursuant to the National Emission Standards Act (42 U.S.C. ( )3 7521 to 7550, inclusive) and the standards and regulations adopted pursuant to that federal act, unless the motor vehicle is equipped with the required motor vehicle pollution control device ( )4 that is correctly installed and in operating condition. No person shall disconnect, modify, or alter any such required device.

....I ask someone to please explain how a non functioning,disconnected and unfilled nitrous system in anyway hinders/or effects the Vehicles emission control system. Intake...fine,my arguement is the nitrous system...at which N.O.S. Inc received an executive order from ARB (Air Resources Board)

See the part in red. You modified and/or altered a part of the emissions system, as it includes the intake.

IN the executive order,it says the systems are exempt of section 27156,as well in testing the systems were found to NOT reduce the effectiveness of the vehicles emissions control system. You can see this stated before the vehicle list. Of course this list is outdated,I am awaiting a new one from Nitrous outlet and N.O.S.

Also, the ticket can be amended to reflect another, more appropriate, section of the code if the judge so desires.

I'll ask again - Does your system have a CARB sticker? You don't need to answer since I already know the answer..............

The cvc section you quote is not even close to the one that covers your current problem.

My suggestion is you find a much more informed source before you try defending yourself in court. :shrug:

just like he said. some nitrous kits are carb leagal and have a sticker. I got pulled over in one of my cars had a zex setup on it long tubes no egr smog pump etc etc etc all he cared about is that it was not hooked up to the bottle.

California is just the temptation state, so much to do, so many nice places, but you lose your natural rights if you want to live there.

Not really not a true statement; what you cannot do in California is thumb your nose at the law and expect to win.

If you live in California; the assumption is you will know and follow its laws - otherwise you can pack your butt up and move somewhere else.

If you install illegal equipment on your car, then get stopped and cited for said equipment - its not the law that is stupid...................as Adam likes to say; if stupid doesn't hurt - it should.

I got issued a ref ticket by CHP as well for my nitrous kit, clear lid, and loud exhaust about 3 months ago, my bottle was empty and disconnected too but he didn't care. I had to attend to court and the judge asked me if I wanted to correct it and end up paying like 200$ or just pay the entire fine which was 390$ and go on my way without going to the ref. Even though he said I ran a risk of getting sighted again, so I ended up paying the 390$ because there was no way I was going to pass inspection with the nitrous kit on or off.

I did fix some things though, I took the main nitrous parts out, zip tied the front plate on, changed to quieter exhaust, and a new black SLP lid. To lay low a little you know.

The new INNOUT off Los Alamos,my self and 10+ other were issued refs as well another 20+ issued other tickets.

I thought they needed a warrant to look under your hood or is that just a myth ? i am glad i kept the carb numbers for my 2.6 now if i can only get one for my lt kooks lol

No they dont need a warrant to pop your hood. They can pull you over and pop your hood anytime they want.

Sometimes I take living in Washington for granted, sure it sucks up here because it gets so cold and most of the woman are ugly, but I love the fact that I can drive my car to the track on slicks and with a strait pipe and not get hassled, shit I drove right infront of a WSP at our last drag strip day of the season.

LOL..Isn't California amazing! They feel a dude has the "right" to marry another dude but there is no "right" for you to mod your car and still keep it emissions legal. This state is amazing
