So, I made my report and never heard anything back. So, I'm not sure what happened after that. I was actually okay, just a little sore.</p><p></p><p>Do what you need to do OP, but unless you have a witness or video of her texting and driving it will be very difficult to prove. Obviously she is at fault since she rear-ended you, but you have to prove texting and she has to prove faulty brakes.
