If I were in your shoes, I would offer to pay them a very large amount of money to not get my dogs put down. Then again, I’m with my dogs at all time when in the backyard to make sure nothing funny happens. I love them too much to take a chance on anything happening.

Okay so after talking to my attorney friend again, and after some research by himself, he states that the whole thing happened on common property, therefore I am only responsible for my fence and my dogs getting out. The dog killing the cat is animal on animal crime. It didn’t bite a human or break out and attack anyone’s dog who was walking by on a leash who were following the law. My dogs would of had to go on his property and killed his cat for it to be a problem, which they did not. Since the cat was originally on my property provoking the dogs it’s on him as much as me for letting it roam the neighborhood without a leash. He said some county’s require cats to be on leashes just like dogs and it goes the same for cats as it does dogs. just because it’s a cat doesn’t make it exempt from animal on animal. at most I might get a fine for my dogs not being on a leash and i MIGHT be responsible for the cost of the pet to be replaced.

It's great that you have this attorney friend. But he's a dope. If you have to fight this thing you will find out just how much of a dope. Let's say he's 100% correct. You will pay for lawyer, court costs, probably expert witnesses and a bunch of other stuff. And dead cat guy will parade a bunch of neighbors who are afraid of your dog(s) and the judge will decide. If he loves dogs and you for some reason, you will be found not guilty of negligence and you only pay 10 grand or so for the lawyer and all. (Not exactly a victory.) If you get the judge that has a child that was savaged by a dog when she was a kid you pay all that AND damages of who knows what. (BIG$)

PS...Don't bother using the "But my dog has never bit anyone or anything before" excuse. They have heard that one a thousand times and it doesn't work.

Sorry for what you are going through. I have dogs and sympathize with your predicament. But I told the wife from day one with dog one that if they ever bit a kid they were silver bulleted that day. And that would extend to a neighbor's pet as well.

If your lawyer buddy is so positive then have him defend you. I'm guessing he might be a bit less certain of what will result if he has to man up. There is only one sure thing about going to court on something like this. Even if you win you lose. You just lose a bit less.

Good luck to you. Hope it works out and your neighbor can get over it. If you haven't asked him yet, perhaps a conversation as to what he expects would help. Maybe you can get away with buying him a replacement cat.

This just happened in my neighborhood this week...almost the exact situation. I don’t lose my mind when I see a stray cat kill a bird or mouse or squirrel, so I’m not going to feel bad when a dog kills a stray cat.

IMO you accept the risk when u allow your cat to roam the neighborhood freely. Sometimes dogs get out

My neighbors cat is always roaming the neighborhood. My kids were playing on the side yard and my dogs saw the cat IN MY YARD and broke through the fence (85lb pit bull and little french bulldog). I hear a knock at the door and the neighbors daughter says your dogs are killing a cat. So i go get my dogs in another neighbors yard (not the neighbor who’s cat it is). They did a number on the cat. he couldn’t walk and both of its legs were broken. They ended up taking the cat to the vet and putting it down because it was paralyzed from having nerves in its back severed, so here’s my thing. I felt really bad about the whole situation and offered my condolences to my other neighbor and even payed his vet bill of $800 even though his stray ass cat was basically on my property where it got killed (died in my next door neighbors yard next to mine). the neighbors who own the cat live like 5 houses down. So he comes over yesterday and says he doesn’t want bad blood yada yada but he’s put my dogs back in my yard like 6 times and my dogs are out all the time lol. so u put my dogs back when they got out but never told me they got out and u put them back? yeah okay buddy. i didn’t say that to him because i was being polite but then he proceeds to tell me other neighbors are scared to walk in front of my house now because of my dogs. yada yada. this whole line of made up shit. my dogs are inside dogs btw. they only go out to piss and play when the kids are out so i know he’s full of shit. then he proceeds to say he just wants to let me know he’s going to file a report with humane animal services and they’re going to want to interview us ect and see the dogs and if they’re violent ect. I’ve never heard of this in my life. it’s not like my dogs attacked a human. they attacked another animal and as far as i know it’s dog on cat crime and that’s just life. dogs eat cats, humans shit, birds fly. it’s the circle of life. so is anyone up to date on laws or what a report is going to look like. my dogs are registered and they are not violent . I don’t even see how animal control can do anything. his cat wasn’t on a leash and it was on my property. i feel like i’ve been fair enough paying his vet fees and now he’s just being a bitch calling animal control on my dogs filing reports ect. What would u guys do differently? Imo he doesn’t have a leg to stand on. i was trying to keep the peace but if he’s going to keep all this up i’m going to have a problem with him. should i let him know? just go along with it and let him do his thing with the report filing or what.
Could’ve been worse. Your dogs could’ve killed a porn star neighbor.

While your heart was in the right place, paying for the vet bills and apologizing was nothing more than an admission of fault. Lawyer up and hope they settle for something less than having your dog taken away and put down.

Someone understands why he paid $800 for vet bills because it wasn't out of the goodness of his heart. It was a preemptive save my arse or int his case mine and the two dogs.

Exactly how does a dog “break through the fence”?

What kind of “budget friendly” fence do you have?

I have (2)Great Danes that are 130 lbs. and 150 lbs. and there is no way they are “breaking through” our 6’ privacy fence.

Put up a real fence before your 85 lb. pit does something worse and costs you everything you have. Especially now that he has one strike against him.

Dogs do not normally kill cats, they chase them. The big issue with pits is their high tolerance for pain and lack of fear. You can kick or punch most other dogs and they will reel back. Once a pit is set on attack, katy bar the door because death and destruction is as sure as the sun rises.

Unfortunately, I think you’re 100% screwed and too naive to see/admit it. Bottom line is, your dog broke through your Walmart fence for a cat, and killed it. While I’m not a “hate the whole breed for the actions of a few” person, there are too many people that are; especially with pits. People actively look for reasons to “justify” putting them down. Your dog just gave someone that reason...

This is true and sad at the same time. I am a full on dog lover and not fond of cats. I dont ever want domesticated animals hurting other pets.

I’m also not impressed with your lawyer friend’s advice. I’ve been through less serious dog situations (no deaths) on more than one occasion and they never played out like your friend is saying.

These two have known eachother MAYBE two months.

My dog has NEVER even nipped at the cat.. sure they might run around.. but the cat smacks my dog.. My dog IMMEDIATELY stops. So thats bullshit that they just kill cats.

Also, before this cat my dog had NEVER seen a cat in her life. But this cat came into the house, my dog is trained you do NOT show aggressiveness at all.

You do not have the attitude of a trustable dog owner.. with the " oh well they kill shit " attitude
