LEO's Only Failure to Comply question

I recently had a ticket (Upstate NY) reduced to a "Failure To Comply" with 2 points on my license. Is this considered a moving violation? If not why the Points? I have been told that it is not a moving violation by DA and told it was by a lawyer. What's the truth?

I received a speeding ticket and was reduced to a Failure to Comply with police order. and it says 1108 on the letter from the DA's office which carries a 2 point mark on license. Is this a moving violation?

It is a point violation. It would be considered a moving violation because of the circumstances. You were in a vehicle that was moving.
