Eating it while driving would defeat the purpose of the police thinking it was a phone. He wouldn't eat it until he was pulled over and stopped by the police. He wouldn't be eating while driving at that point.

note to self...when acting like a dumb ass to provoke cops to pull you over to be funny, make sure you don't have any outstanding arrest warrants!!
