Can you be terminated?

So the company I work for who shall be named Company X introduced to the employees for the year of 2010 a policy which they labeled "Social Media Policy." For a generalized explanation this policy pretty much encourages legally appropriate "advocating" of the company and discourages dissent on social networks such as Facebook, MySpace, Twitter etc etc. My question is, do many companies have similar policies? Can one be terminated for saying for example "Work sucks, Company A sucks" on Facebook while being employed at Company A? Under the FAQ section it names not one thing about the legality of such "expression" on Facebook for example, other than the term "freedom of expression." I can't imagine that one can be terminated for such a thing due to its questionable nature, but then again it is a private company. I can't say I'm not looking for legal advice lol but my question stands: Can an employee be terminated for "bad talking" their employer on Facebook when the company has an established policy against such a thing?

It all depends on your employment policy at your employer. I am employed at an "at will" company, meaning either of us can terminate my employment at any time for any reason.

You live in Florida. Florida is a right to work state. You can be terminated for anything the company chooses as long as it's not due to you being a member of a protected class.

Yea, but that doesn't mean they can fire you for speaking your mind on an unrelated public forum. What you do off the clock is your own business. If you're doing it while on the clock, then yes, they should be able to bust your ass just like the moronic football players twittering while in meetings.

Nope, in Florida they can fire you for anything on the clock or off, as long as its not a protected class. Plus, if you ask why your being fired they don't have to tell you either.

Wouldn't you fire an employee of yours if he bad mouthed your company on a website??? If I were the boss, I'd send you a message on Facebook telling you that I'd fire you the next day.

I think you'd do the same thing....or at least want to.

Well that doesn't seem fair lol. How can a company do such a thing? Free speech doesn't apply in relation to an employer and employee? I always figured such things were unconditional in Constitutional nature.

I'd want to, but just because I'd want to doesn't mean I should be able to because the comment angered me. Does that go to say that if I would like to maintain employment I cannot ever mention anything related to the company that is negative? Where is the protection for the individual? Wouldn't you want your right to say whatever you please for or against your employer when not on grounds or on their time without any consequence? Am I being to stubborn about this? I don't think its unreasonable to question it.

why would your company want you to work for them if your bad talking them? Its only going to lose them business, especially if they have an employee telling everyone how shitty the company is...id say that is a reasonable reason to fire someone.

It basically boils down to your statements being a conflict of interest. You are engaging in activity detrimental to the success of the business and that is easily justification for your termination.

Who said life was fair? If you don't like the company or their policies, quit. It's pretty simple.

Yah -- it's pretty simple. Don't say bad things about your company and you get to keep receiving a paycheck.

It's not really about not being legal, it's about not being a douchebag to the hand that feeds you. If the company is so bad that you feel you need to slander it online -- anonymously or not -- you need to re-evaluate your continued association with such an awful employer.

lol you do know that companies pay Facebook to see every picture and every comment you have posted or someone has posted right?? And it doesn't matter if it has been deleted, its stored in the Facebook server. The privacy filter is bs.

nothing on the internet is really private and honestly if your stupid enough to post something about your work on a "social network" site and its in a bad light.... well as I always say do what you can afford.... if you want to not worry about your job dont tempt them to fire you

id do the same, but that next morning id like to hear why said employee feels the way they do. Just like that new show where CEO's go undercover as n00b employees are finding out so much about their business that they never knew. People on the bottom are sometimes the ones with the best ideas on how to make a company more efficient, save money, increase profits, etc.

I'm not bad mouthing nor do I intend to. I was just curious if Facebook / MySpace and the like kind of comments are grounds for termination. I understand it all but what about the individual? Can they not comment as they choose? I guess not lol.

What show are you talking about thomas?
