What you do really depends on your company and how you approach them. I worked base salary plus commission before becoming fully self- employed (20 years now).
If you say your leaving to work at another company in competition with them, be prepared to be escorted out pronto.
If your approach is “my wife is being transferred to another state for her position and unfortunately I must follow. I really like working here and wish I could stay” seems non confrontational and caring. Bet they will work with you on a exit strategy and commission payment. Most companies care about perception in this age os social media.

I will try to keep this short: my wife got a great job offer last month and we will likely move one state over. She is in traveling sales, so it will be better for her overall. We have thought of moving before, so now is the time. We would be moving at the end of March.

I also work in sales and I've already put out feelers to some companies the next state over, so my prospects to land a new job are decent. I feel a need to tell my current manager that I will be moving next month, however I'm afraid to give her any notice. I've got some commissions coming my way March 31st, so I don't want to get canned as soon as I give notice of my resignation. I've only been there 8 months, but my manager has treated me fairly for the most part. Lastly, the employee handbook is vague on how commissions are paid once you resign. Plus, it says nothing about giving a notice to resign...nothing. I'm worried they will find loop hole to not pay my commissions.

So, do collect my commissions, then leave without notice or give 2 weeks notice and pray I don't get terminated on the spot?

EDIT: Since I'm a newer employee, I get paid a small base salary plus commission on what I sell. If I put in my resignation, then get terminated.....does that qualify me for unemployment possibly?

As a business owner, there is NOTHING worse than a mother ****er leaving without 2 weeks notice. And I mean NOTHING. Do the respectful thing and turn in your 2 weeks. It's a sad situation when people don't realize how much frustration and heart burn they are creating when they just leave on the spot. Your replacement is going to cost big money. PLUS, your new employers might be calling your old boss. You want a good review. You must leave on good terms, and you will earn that respect.

That being said. If you are worried about your commission, have them sign a contract stating you will be paid before you leave. If they don't pay out, you can sue them. You can type it up yourself, no big deal. A respectful boss will pay you out no problem. Especially if this is your dedicated account and your sale. If others "share" the territory just make sure your name is specifically listed for that specific sale, with dollar amount. I would NEVER burn my sales guy, even if he left without notice. Although I would be outraged.

ps- don't tell them shit. You are only moving because your wife got a new job. As far as they know, you don't have a new job. They will "feel bad" you are leaving.

All great advice. I’m still torn, however I will likely be honest with my manager. What she does with that will be up to her. I’m going to give it till next week to see how I feel. I did talk to a couple reps that recently left. They both gave me different stories about how commissions are paid out once you leave (they both left without notice). There is some intentional gray area in the employee contract. I would like to call HR to have them clarify, but that would throw up a red flag to my manager.

I've been managing sales organizations for 25+ years. I'd appreciate the notice, but would still process you out that day because you are now a distraction for the rest of the sales team. I'm not worried that you would take IP or customer lists as if you were that type, you would have done it before giving your notice. I'd still process you out the same day if you gave me notice with the "wife got a new job and I need to follow her to another state" reason. Why? I know you need a new job in the new state and I simply don't want to pay you to look for that job.

Check your employment agreement regarding your commissions. Companies I've worked for require you to be an employee of record at the time of payout.

My recommendation is to collect your commission and then give 2 weeks notice. Odds are they'll process you out that day, but if they make you work it:
1. is the commission sufficient that it could cover a hotel room for the 2 weeks and still leave you with mod money?
2. how much leave do you have? Give notice and go on leave - not unheard of.
