Sexual Harrassment Complaint

    Does anyone know the law about if you can request to find out who filed a sexual harassment complaint? I have worked at this job for 32 years and never, ever touched a female employee like that. But there is an employee who has already taken one of my jobs (A blessing in it's own) and now she wants to get rid of me. So someone filed a complaint against me. The President/CEO of the company told me he knew by the look on my face when he told me it was false. I told him you bet it is. He told me to stay away from the women at work. Kind of hard when it is 18 women to 5 men. Plus they are all the time asking for help with their computers or their jobs. I guess no more unless they leave their station and walk away to a far corner. What gives with women today. Plus than the good Lord above my boss believed me when I told he there was no that would ever happen. Most of the ladies I work with are either elderly or very obese except for 2 maybe 3. SMH.

    Oh and the 2 or 3 work at other locations at least 13 miles or so away from the main location that I work at.

    First, understand that sexual harassment does NOT have to be making physical contact. If you make an off-color comment about any person's sexual preference (whether it be a joke [that bitch needs to get stuffed with a fat dick], a sarcastic comment [dude, you're a fag], or as an insult [that bitch is a dyke]), and somebody that hears it is offended, then it can be classified as sexual harrassment.

    If your boss believes that you did not do what the complainant claims that you did, then I would not worry about it. If it happens again, then I would ask your boss to hold a closed door meeting with you and the complainant and work it out in private.

    Furthermore, it can be a picture or something else. It really is crazy how easy it is to "sexually harass" someone.

    I appreciate the comments. I have never knowingly said anything like that as I know of. After 32 years I am truly thinking about leaving the company. It has gone to heck in a hand basket. I have been the security officer, It Officer and both jobs entail making sure this kind of stuff doesn't happen but yet it happens to me. SMH!

    Oh and the thing I did not say in the first post was....I touched a female in an inappropriate place and manner was the main complaint. Like I told my boss I do not recall getting close enough to any of the employees to touch them inappropriately. Maybe that's why he believes me along with my astonished reaction.

    Both of these hold truth. OP, ride it out. If you have been there 32 years and your boss knows your side of the story is true, then don't sweat it.

    I am trying my best not too. If it is whom I think it is, she just wants my job and she is pure evil. Anyone that knows her inside the job or outside knows she cannot be trusted and get what she wants, when she wants it.

    Sounds like you should be filing a complaint. Clearly this has made it an uncomfortable place for YOU.

    You work in a place with cameras everywhere. Ask for the full complaint with specific times, dates, and locations. Consider a civil suit for defamation if you can poke enough hols in the story.

    I was going to suggest something both funny AND a felony.

    Sorry I had not been on in a couple of days. Hope this doesn't go to SD OldModMan. I told my direct boss what happened Tuesday morning and he about fell over. He was like, anyone else but you. He said he can already guess who did it. Same person that I had in mind. I am just waiting to see what happens. We had meetings all day Tuesday and then way too much work yesterday to figure out any more details. But I did get to tell the President/CEO that someone had been sneaking a look through my electronic time card and broadcasting it around the work place. When I put a password on it the person doing it had the balls to call me and told me to get it off. The President said put my password back on. So I am waiting to see what new accusations they come up with. FiveOGirl, the one or two that I think it could be or they are conspiring together ARE pure evil. I cannot go into details but the one I have never turned my back on. She has taken a lot of men down in our area. If I mentioned her name or initials Travis (aka SID297) would probably know who I am talking about. She lives to put men through pure hell.

    One key element of sexual harassment is that the harasser's conduct must be unwelcome. Seems like you would have to have been placed on notice by her or a supervisor prior to this for it to actually be deemed sexual harassment.

    When I was confronted Monday by this, it was the first I had heard of anything. I guess the meeting Monday was my "Notice." Who knows. Politics at it's best (or worst.) I can tell you this straight up. I have never touched ANY woman at my job in ANY manner to be considered "sexual misconduct." From Monday on if I have to go to anyone's desk to work on their computer, printer or any other piece of equipment I have asked them to either leave the cubicle, office or work area by at least 5 - 10 feet. This never happened in the first place and it sure will not happen in the future.

    Never knew my ex moved to WV. Seriously though, watch your back. Employers are stuck if there is a complaint, even if they know it is not true. If they fail to discipline/fire you, and the woman keeps complaining, she can take them to court for a hostile work environment. Men almost have to pair up and never be alone when a woman gets on a harassment kick.

    That's what I am afraid of. Yesterday the two I think may be spearheading this came to my office separately. I was tearing down a printer to see if I could repair it. I really did not want to be there by myself but it could not be helped. I am going to talk to the President on Tuesday to see what his suggestion is on protecting me because my office is on a floor all by itself.

    untrue. if someone sees / hears something even that was "welcome" but they take offense to it a complaint can be filed and action taken. ask me how I know.


    have a recorder or video camera set up in your office. if they come in say "you don't mind if I recored this do you?" and turn it on. if they say they do then say you have nothing to discuss without a third party present. just make sure you say it with EVERYONE that comes in your office

    Truth. You can make a joke to a girl that's "one of the guys" that sexually harasses you more than her, all in fun. Another girl hears what you say to her and can file sexual harassment. Furthermore, unwanted act doesn't mean you have been notified that it's unwanted. Doing something that is unwanted is grounds the very first time, no warning, even if 99% DONT think its harassment. It's all about how the person harassed perceives what happened.

    Oh, does THIS bring back memories of my work days. I had one EVIL woman that filed EEO complaint after EEO complaint - a total of 9 or so. Went through every Federal EEO Admin Judge in a major city with NO finding of discrimination. The problem is that the complainant actually gets, under EEO law, five bites of the apple. Informal complaint, formal complaint, EEO Hearing, appeal to the EEO Commission and they can take it into Federal court anytime they want - NEVER let them know that.

    I speak from experience and have deep sympathy for you. If they keep it up, management begins to think you MAY be a problem without ever realizing that the complainant might be the REAL problem; they actually are not very productive, either.

    Be careful and if they come up to your "area," let them know this makes YOU uncomfortable and ask that they meet with you in a public area. Turn the tables and document, document, document. A video recorder in your office is a great idea.

    Been there, done that. My problem child got reamed out by the last EEO Judge and was embarrassed in my presence - she really needed that for her to see how stupid she was being. She ended up dropping all her complaints after a time.

    NEVER underestimate the power of an EVIL mind - male or female! They think in ways that are incomprehensible to normal people.
