Really? This Qualifies For "Stand Your Ground"

    I agree. As soon as he brandished the gun, the other guy backed away. At that point he no longer had the right to fire imo.

    Yep, 100% justified. If the shooter had not fallen to the ground, he might be on dicier ground.

    What will happen to shooter civilly is another story.

    So stand your ground law covers any place you may be , not just your home or automobile ?
    Appears the dead man was killed protecting his girlfriend from the shooter ...just saying .
    This is why I believe everyone should carry.
    And the shooter should have his carry permit revoked .
    I am certain he would then be come your usual thug , still carrying and a felon soon after .

    I see your point. At what point is someone acting like a tough guy just to instigate a fight and then use deadly force when somone pushs you to the ground. You would go striaht to jail if you did that in CT

    This is he way it works, it fits within the basic framework of stand your ground so the local agency sends it to the state for final determination. This guy is not off the hook yet. There have been ohers not originally arrested that Ended up doing time

    I think each state has their own definition of “stand your ground”. Some states are more lax on it.

    Ohio mostly associates stand your ground to your home and automobile confrontations.

    In addition in Ohio, if you have the opportunity to retreat ( not necessarily in your home or your auto standing your ground) to reduce the threat of using deadly force, you must do so. There is legislation in Ohio to change the provision. I don’t know if other states have this provision.

    Hearing the interviews from the owner and the other patron, it sounds like the shooter has been trying to get into fights so he has an excuse to use his gun. Hopefully the law doesn't allow him to get away with it.

    The shooter was yelling at/threatening the victims girlfriend. Most men I know would not "mind their own business" at that point.

    The man had threatened people in the past at that location to the point the owner of the business had to get law enforcement involved.

    What a shame a Father had to lose his life in front of his 5 year old boy doing nothing more than defending his girlfriend by knocking an aggressive stranger to the ground. It was not like the victim jumped on the shooter and started pummeling him or was reaching in his clothes for a weapon.
    The victim clearing started walking away with his hands in plain sight when the shooter decided to pull the trigger.

    Does arguing over a parking spot justify being assaulted by someone who was not involved? What's to say the pusher/shover would have stopped if the man did not draw on him? Either way, what happened was senseless because it was over something ridiculous.

    Once he drew his gun the guy backed away and he shot him anyway. Murder.

    The victim was "involved" because it was his girlfriend being threatened by the shooter.

    The more I look at it... The shooter had the opportunity to retreat prior to using his gun. Looks to be manslaughter at a minimum....I’m not an attorney, but I did stay at a Holiday Inn Express.

    The shooter was a good two feet from the car pointing his finger and lecturing. The soon-to-be-dead guy just comes up and shoves him to the ground instead of trying to talk it out or just blow the whole thing off and leave. I have no idea why the woman got out of the car except to add fuel to the fire. If dead guy had not touched the shooter and talked it out or just ignored him and got in the car and drove away he'd be alive and well which is why he should not have messed with a stranger over a parking spot.

    I think the backstory is tainting your opinions. Morally he had an obligation to walk away. Legally he did not. Unless the guy walked away further than where the video stops I don't see a problem here. It's too bad because i was hoping it wasn't the guy with the kid getting shot
