First Offense
Driver's license revoked for 90 days to a year
Imprisonment for not less than 2 days nor more than 6 months or perform not less than 48 hours community service
Fine of $400 to $1000
Completion of court-mandated DUI school and payment of tuition
Substance Abuse Evaluation for offenders with BAC of .18 or more



Second Offense within 7 Years
Driver's license revoked for 1 year, not eligible for restricted license
Imprisonment for not less than 10 days nor more than 6 months
Fine of $750 to $1,000
Substance Abuse Evaluation
Perform not less than 100 hours, but not more than 200 hours of work dressed in distinctive garb



Subsequent DUI Offenses within 7 Years
Driver's license revoked for 3 years
Prison sentence for not less than 1 year to 6 years
Fine of $2000 to $5000
Guilty of Category B felony



DUI causing death or serious injury
Driver's license revoked for 3 years, not eligible for restricted license
Prison sentence of 1 to 20 years
Fine of $2000 to $5000

Clues that a Driver May be Under the Influence

Recognizing an impaired driver may keep you from being a DUI victim. If you see a driver doing any of the following, watch out! They may be driving under the influence of drugs or alcohol.
Making a turn too widely
Using two lanes, straddling the center line
Almost hitting someone or something
Weaving or drifting from one side of the lane or road to another
Driving off the road, or going straight through on turn lanes
Driving much too slowly for the speed limit or traffic conditions
Stopping in traffic without a reason
Following too closely
Driving with tires on lane marker or center line
Erratic braking
Driving in oncoming traffic or cross traffic
Responding too slowly to traffic signals
Turning abruptly or illegally
Driving at night with the headlights off
Swerving to correct course
