No, I wouldn't. Nor is that what it appears is happening here. As long as the company is not breaking the law, there's no real consequence here that I can see. Last I checked, companies aren't required to verify that those sales are being installed on off road vehicles. It seems to me that the company in this case is seeing media reports of the EPA cracking down, or a trade association report of the same, or is hearing through the grapevine "rumors" of crackdowns. But, I haven't heard of a single instance of the EPA suing or prosecuting an aftermarket parts supplier for selling off road parts that somehow make their way onto the streets. Maybe there are instances.
I don't think we know what has been recently happening behind the scenes. They didn't stop making product based off of a media report.

They state that any device that defeats factory emissions components on any VIN’d vehicle is illegal; regardless of how that vehicle is used. If the EPA is allowed to go around just threatening instead of litigating, they'll leverage themselves across this country and impose their will.
