Accident question

Hey guys, this question is more for the Lawyer I guess.

I was in an accident back in January this year (car was totaled and already paid for by other person). The insurance company found the other party at fault and I am now working on a case for pain and suffering/medical cost. Like all insurance companies they are screwing me around saying I have no case. I am currently in school to get my Doctors degree and my wrist is still effed. My wrist took alot of impact, and tore a tendon, now my wrist is unstable and pops alot on top of hurting with multiple different things. Mainly things like writing for a long time, I cant bow hunt this year as it hurts to pull back my bow and also different activities at school I must do cause pain. Here is where it gets tough, my wife is the Doctor that has been taking care of my wrist, although she did refer me to another specialist orthpedic surgeon who is seeing me again in a week or so. So naturally because my wife is the Doctor, they want to pay nothing since it doesnt cost me anything. I havent had surgery on it due to the fact I wouldnt be able to complete schooling until rehabbed and want to wait til I am graduated to make that decision. So, they are saying as of now I have no case and are offering me zilch! My point is that this could cause a huge problem for me when I graduate being that I use my hands everyday with patients. Anyhow, what is the best thing to do. I have talked to a lawyer but like most didnt give me much advice unless I start paying. What is the best way to go about this? What can I do to help my case out on this.

I dont want to go elsewhere for care as I would have to pay out of pocket where I could get free care through my wife, yet I dont want to get screwed because insurance company can manipulate the way it looks for my care.

You are kind of in a tough spot. Insurance companies want to see a doctor trail to put with your injury. With your wife taking care of you there is no hospital paperwork they can look at. When I have had a couple accidents they always took a look at all the doc visits, physical therapy, missed work, etc.. when determining some kind of pain and suffering. Plus they weigh in surgery and permanent damage when figuring out an amount. Good luck with this, and maybe go see a lawyer that will take this on a contingency (they get paid when you do).

Get a really rabid attorney and send him forth to do battle, murder, and pillage.

Look up his success rate and settlements that he has won. Pick one based on results. The insurance company is not your friend.

Well there is the ringer, My wife by law has to keep paperwork regardless of relation. She has all the paperwork, treatments, etc and has sent them to the insurance, in which they said the will not reimburse for care nor pain and suffering, because "my wife has no reason to get me better, the longer she keeps me in pain, the more money we get". Which infuriated me, my wife went through almost 7 years of schooling, not to keep people injured! Damn insurance companies. Everytime they call me, I get off the phone wanting to hunt them down and treat them like POW's in Guantanamo Bay.

You need to hire yoursef a good personal injury attorney and then, do not talk to the insurance people yourself. Allow the attorney to handle all correspondence with them. They are trying to get you aggravated with them hoping that you will drop the whole issue.

Im trying to understand, if your wife treated you for free, what is the insurance company supposed to reimburse?

I can see what they are saying. Your wife may have gone to school to help, and while she may not be a shady individual, other doctors have gone through the same schooling and are shady. I'm sure this insurance company has been scammed before so they are going to be vigilant in making sure it doesn't happen again.

Is your wife treating you on her off time or during office hours? If during office hours, I can see getting compensation for that as it still relates to her business and she could spend that time doing other things around the office. If on her personal time, I can't see getting compensation for that being as easy to get.

That said, either way you will be entitled to pain and suffering, missed work, etc regardless of who treats you. Your wife treating you does not negate the fact that the accident happened.

I say get an experienced lawyer. He will know a lot more about this than you and may be able to get you more compensation because of it. Insurance companies don't **** around but neither do lawyers.

Pain and suffering, Loss of enjoyment (cant hunt, play baseball with my son, etc.), Hardship, not being able to do what I need to at school.

She is treating me during office hours, and trust me I know there are shady Doctors, but the way they put it (she is keeping me hurt) pissed me right off. Yeah, Im sure my wife wants me hurt so I cant carry groceries without pain, cant write for periods of time, cant play sports with my son, cant hunt. She gets real enjoyment off that. My wife has said numerous times she wants this whole thing to be over, but I may need surgery and I just cant do that right now, it would screw up more than any claim would be worth IMO. I definitely am getting a lawyer, no question on that, I guess I am trying to be frugal with this as I dont want to get screwed over.
