I would lean more towards him being dead because the impact of that brick to the back of the head is not going to have anyone back up on their feet the next day.

So then whomever supplied that brick if it came from one of those pallets should be charged along with everyone involved in the asault. Hopefully the investigators are not corrupt and this is not buried which could be quite possible.
