Dealing with crazy HOA's

They have changed companies three times now but I hold personal property. The new one starts at the first of the year but I followed up and with the notice but walking on personal property is questionable, right?


As someone with lots of experience with HOAs I'll tell you that the company means absolutely nothing. They can change companies every two months but the fact remains that the company works at the direction and pleasure of the HOA itself.

Additionally any evidence gathered illegally cannot be used against you. This would include someone entering your yard without prior notice. More than likely in the cc&r there was a self correct section which means that you have so many days to correct the problem before the HOA has the right to come onto your property and do it themselves. This does not sound like the case if someone is just snooping around.

From what I can tell there was a violation and measures are being taken to correct it. However that does not justify the wife of an HOA member to be on your property. In fact, the wife has no business conducting HOA business if she's not on the board of directors. This would seem like a bigger violation of trust and policy to me than anything else and I would personally make a deal over it.

You should have called the police and pressed charges. You have to stand up to HOA's or they'll walk all over you IMO.

I had an HOA enter my house twice. Once I was in a renter in a condo and was asleep during the day (third shift) and they entered my bedroom while I was sleeping. I woke up as they were high tailing it out. The second time was in a townhome, same scenario except I had two people in my living room. The second time they were greeted looking down the barrel of an AR. I called the police both times and pressed charges. The second time they waited face first on the living room floor until the police arrived. Neither time ended well for the HOA legally.

I wasn't involved in the first case as the owner took them to court. I just provided statements on what happened. I know I got a bunch of free rent after that and a new management company took over.

The second time the HOA was disbanded and the HOA officers were fined and given supervised probation (I don't recall the exact term but I think that's what it was).

My father is in court with his HOA now. The law firm working his case said HOA's generally get too big for their britches and it's easy to catch them violating their own agreements if you have the follow-through to stand up to them. I imagine the OP could wreck the HOA if he chose to pursue this.

So I took the police officers advice and padlocked both doors, now mind you I live in a very upscale neighborhood and I have a service that treats my lawn throughout the year which I had to call and have them email me prior to them coming out because of this twat, GRRRRRR. Why do people have to stick their nose into some else's business blows my mind.

This is why I made sure I purchased in an area with out an HOA but still was a uniform area that appeared to have people that regularly cared for their property.

This is what I'm doing next time for sure! What a waste of money to cut grass and pay for a pool I'll never use because its riddled with infants that pee and poo in it, plus pay for insurance.

Man...glad you came out of that for the most part. You're either in their sights or he put his wife in check and told her not to even look your way. Either way...if your not absolutely in your "forever" home not a bad idea to start looking. That and cut the grass ;) You definitely sound like you have a good bit going on and I wish you the best on that. We have only had one issue when we got a $1200 fix it get it threat fine. My wife is a paralegal and she handed the City Official his ass. He did not cite the ordnance correctly and she called him on it. It was a few falls ago and there were leaves on the ground..just like EVERYONE else. Luckily no other issues as I try to keep the yard in shape.

I hate my hoa and neighbors, mine is pretty restrictive. My neighbors next door have two shit cars they like to park in front of my house because they don't want them in front of their house. I have nice things I paid good money for along with an appearance I like to keep with the community. I understand the 3rd shift frustration as I am on call 24/7/365 but I make it work along with working 8-5 m-f. Everyone has their own opinion, personally if I don't have rats or other pest I could care less what you do next door. However, prolly shouldn't have done what you did

I agree, he assaulted her phone and her bike, poor things.

I think she gets the point VERY well for not being touched at all. Lucky she didn't receive something akin to real assault, which she was begging for.

If I ever see someone in my yard my weapon goes with me, no exceptions. Her actions COULD HAVE cost her her life. I honestly hope she realizes that with her snooping on something that doesn't even effect her.

Sorry guys I need some advice on dealing with HOA's. About 45 min ago I woke up to my dogs flipping out as I was sleeping due to quitting my previous job and taking a contract one that provides me to do 3rd shift work which sucks working nights but it's AWESOME PAY. So I know that guys that work nights sleep through the day like myself but you tend to let a few things go that the normal 9-5 crew can get done, unfortunately, I let the grass slip because of working nights, taking care of two dogs, grocery shopping when I can, cooking, laundry, helping both my parents and grandma with stage 2 cancer I'm burnt out. So fast forward I get a notice from the HOA about the grass and bushes, fine I got a guy to take care of everything. Again this afternoon some old bitch is riding her bike taking pictures of everyone's house but decides park her bike in my driveway and proceeds to open my gate (aka trespass) and starts taking pics of my backyard, needless to say my dogs hear everything and flip out, I open the garage and catch her in my yard and confront her. She tells me she's the wife of HOA President and has full access to my property in which I laughed and we got into a disagreement which led me to taking her phone away and snapping it in half in a bit of rage. I also took her bike and threw it into the street again explaining she's trespassing and can not go any further than the parkway as it's my property. She was fueled and said I would be talking to her husband and lawyer.

My question is how kinda screwed am I? I also caught her on my phone and left it recording in my pocket getting voice.
In the county and state I live, the law is clear, you cannot open a shut gate/fence to even knock on the door without a warrant. Law enforcement included. I hate HOA’s personally. The HOA can tell you/make you fix anything out of the agreed expectations visibal from the road however in most cases.

whoever said you have anger issues is crazy. that's a perfectly reasonable thing to be bothered by.

HOA's are despicable nonsensical nanny state bullshit entities that destroy community under the guise of protecting communities.
