Daily rear ended (totaled). How to get the most from insurance?

As everyone said, find comps and fight their offer.

What I've noticed is this. They make the offer, and say your rental is due back within 48 hours. If you want to dispute their offer, they may entertain your comps/findings, but they will be slow about getting back. Why? A LOT of people can't afford a rental out of pocket and will then just take the lowball offer. I did that, sent them 5-6 similar cars for sale, and like 7 business days later they got back and their $3,600 offer was now $4100, which is right on with what I think said car was really worth at the time.

Idk. Yes the insurance companies are in it to turn a profit but at the end of the day the outcome of these circumstances more often than not heavily depend on how you interact with the insurance company.

Treat them with kindness and respect and you might be surprised.

5 years ago some idiot kid pulled out in front of me and I T boned his Cadillac with my 1988 square body 3/4 suburban that I paid $1500 for about 6 months prior.

His insurance paid me just over $4,000 and kept the title clean.

That shit was a tank and after $200 in new sheet metal and a few hours of work— she was like new.



2 years ago my 1994 Honda prelude with 289,000 miles got stolen. I paid $700 for that car.

USAA paid me $4200 for that one and I bought it back for $250. Sold it to a friend for $1700 a week later.

Find yourself a kid (or a Russian) who knows how to manipulate the internet. Have him create numerous accounts of like cars being sold at $23k- $27k. Present evidence to the insurance company.

I went through this earlier this year. Actually, I’m still dealing with it, just got another MRI done a few days ago.
Glad you’re alright, might want to go see a doc/chiropractor just in case though. Initially i wasn’t in a whole bunch of pain but things got worse the next day...
as for my car, I was dealing with a major Corporation’s insurance company and they paid what I think was acceptable for my Cobra. We paid 3500 for it and I got back more than we paid, and also got back most of the money I had put into it.

Others are right they will scour the internet and look at current prices for you current model and then they’ll pay you according to that, at least that’s how it was with my case. Good luck man.

When my 97 cobra was totaled due to hydrolocking it, the insurance company based its value off of 10 other cars for sale on craigslist in similar condition.
They told you they based there value off that?

Its been a week and my neck and back are totally fine. I was expecting to be sore in the morning after but i was just fine. Thanks Mercedes!

Im gathering my list of "comps" even though the car with those options is so rare i am really struggling to find comparable ones. They made less than 7500 of these cars from 03-06 and only 1700 in 06, which was the year I had.

you can also use ebay for comps. especially ones that sold.

Call their insurance company and tell them you want maximum payout for being a rare car. I would think you'll get a decent check

Lawyer up. Hate lawyers, but that’s their favorite game. To get their client as much as possible.

Agree, Pretty sure he’d have to go down the personal injury route for that to happen though.

I Have a buddy who is going through a claim, it’s been drug out over 2 years, but he’s about to be paid out $40,000. Unsure how much the lawyer will collect from that though. He was T boned and spun, hit hard enough to total out a pretty new A4. Air bags all went off, his 4 year old kid was in the car, a really bad situation and all because a lady wasn’t paying attention. He’s entitled to every dollar he gets imo.. same with you OP!

The problem with that philosophy is, you never talk to the same person twice with that company. Some are cool, others hate their job and don’t care. It’s like insurances companies take joy in screwing people over.

State farm is giving me just under $14,000 for the car. Fine by me considering I paid $8500 for it and i do believe that is a fair market price for it. I was ready for them to lowball me but i was pleased when they told me that.

Now the problem is finding another one like it. They are hard to find with the miles/options and price mine had!

Any rear ending, or major damage to a car and the BEST advice I have is do not yourself talk to any insurance company or their representative, have your lawyer do that. It could be months before you notice any physical pain (neck or back related).

The guy on the other end of the phone wants to limit his companies liability, that is not what you care about.
