I need legal advice on fraud.

Long story short. I had to buy Obamacare for 6 months before my Medicare kicked in. When I called to cancel my Obamacare I asked the Healthcare Marketplace rep if I still had to pay the Accidental Death Insurance and other policies I was told I HAD to buy to qualify for Obamacare. He said, Say that again? I said the original agent told me I had to buy other policies to qualify for lower health care rates. So I did to the tune of $220.00 a month. He said that I was frauded by the original agent as something like that was not part of Obamacare.

Well I went to my bank and filed fraud charges and asked to have my money put back into my account by returning the electronic items to the originating bank. This has being going on for almost 6 weeks. This evening I found out the originating bank WILL NOT let my bank return these items due to fraud unless I get a court order from a judge.

My question is what would this entail? I am looking at almost $800.00 and a lawyer would probably cost me that or more. Could I do it in Magistrate Court?

Any suggestions would be helpful, even if you tell me to walk away. I HATE THIEVES. I really do and this guy was a smooth operator.

I’d try to file a grievance with the company/Agent.

The amount of time, energy, and stress to deal with a court wouldn’t be worth the 800 to me.

I have tried. The Healthcare Marketplace told me to file a complaint with the FTC. I have. I now have to wait to see what they say. It sucks. I am also going to file a complaint with our Insurance Commissioner's Office and also our State's Attorney General. If I fight this it may save someone else.

I think your state's AG will be the most helpful in this case

Update on thread. Sorry i took so long but connecting a lot of bases. BB&T really screwed me. They would not return the 3 disputed withdrawals from this year. Said they were untimely. They were not until they took their 30 business days time to "investigate." Crazy. I even talked to 2 federal examiners for ACH transactions and both said that BB&T dropped the ball and owed me the 3 transactions back. BB&T still refused. I have now an investigation open with the Federal Trade Commission and WV Division of Insurance. I will have to wait and see.

Report it to the Insurance Commissioner for your state. Nothing will pull a license quicker than fraud.

Contact the company that issued the policies. Assuming that they were real: a lot of times the defrauder is pocketing the money and gives you fake information.

If he did it to you then there are more people who were sold. State AG will be interested in a class case.

I have done that also contacted the FTC per advise from the healthcare.gov marketplace representative. It takes 45 days to allow them to respond accordingly. BB&T really dropped the ball.
