Hey guys, just wanted to get some insight from those who've had to file claims with their collectors car insurance. Back in November I tapped another driver going into a round-a-bout and the mustang was repaired with no issues from Heacock. My concern now is the other driver has sent a demand letter. I've never been through this before so kind of nervous. What should/shouldn't I be doing?

Why are they filing suit? Did Heacock not pay to adequately cover their expense? Did they claim they suffered medical injury?

Do you have an umbrella (liability policy?)

Know the details of your policy and talk to your insurance carrier.

If you have a friend who is an attorney, ask them.

I meant to say they sent a demand letter. From what I understand they're trying to settle with my insurance. No umbrella policy and no other insurance other than for my DD under a different company either.

Let the insurance company handle it. That is what they get paid for. And do not say anything their insurance/lawyer about anything.

I just want to make sure that I've done my due diligence to protect myself.

Did the letter come from the driver or his insurance? It is not unusual for the other party insurance to send you a letter, just turn it over to your insurance. Unusual for the driver to contact you unless he was uninsured. With full coverage just turn it over to your insurance company and let them handle it. I would not be talking with the other driver or his insurance company. Your insurance has lawyer to do that. We just went through this a couple years back and all turned out okay in the end but took like nine months because there was injury on the other party.

My insurance company has been handling everything and has been keeping me updated. Theres been no contact between myself and the other party since the day of the accident. Looks like I'm in the same boat you were in as the other party is claiming injuries.

I had something similar happen to me in my 95. long story but based on some things said by the other party (INCLUDING that they were uninjured) I called my insurance and told them about the conversations and then said" you can do what you want but I would not pay them a dime before investigating the driver thoroughly. I got a call from their lawyer a few months later saying my insurance denied their claim and that if I didn't pay up he was going to sue. told him to do his worst and **** off (used those words). they wound up settling for pennies because the driver was a shit driver.

so yeah let your insurance take care of it but be sure to stay in touch, preferably with the lawyer handling your case
